OVERVIEW

Welcome to Aiba World! The terms “we”, “us” and “our” refer to Aiba World. We operate this website and online store, including all related information, content, features, tools, products and services (the “Services”). Our storefront is hosted by Shopify, which enables us to provide the Services.
These Terms of Service (the “Terms”), together with the policies referenced here, describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy LINK. If you do not agree, do not access or use the Services.
Your statutory consumer rights under UAE law are not affected by these Terms.

SECTION 1 – ACCESS AND ACCOUNT

You represent that you are at least the age of majority in your country of residence and you consent to allow minor dependents to use the Services on devices you own or manage. You may be asked to provide information such as your name, email, billing, payment, and shipping details. You warrant that all information you provide is accurate and that you have the right to provide it. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not sell, assign, or license your account.

SECTION 2 – OUR PRODUCTS

We strive to describe products accurately. Colors and appearance may vary due to device settings and lighting. We do not warrant that any product will meet your expectations or exactly match on-screen renderings. Product descriptions, availability, and pricing may change at any time without notice. We may discontinue products and limit quantities to any person, region, or jurisdiction.

SECTION 3 – ORDERS

Your order is an offer to purchase. We may accept or decline any order at our discretion; an order is accepted only when we confirm acceptance and process payment. Review orders carefully before submitting; we may be unable to cancel after acceptance. If we do not accept, modify, or cancel an order, we will attempt to notify you at the email, billing address, or phone number you supplied.
Your purchases are subject to our Refund & Return Policy LINK. You confirm that purchases are for personal or household use and not for commercial resale or export.

SECTION 3A – HOME TRIAL PROGRAMME

Aiba World offers a complimentary in-home viewing service ("Home Trial") for customers in the UAE, subject to availability and scheduling.

1. Nature of the service. A Home Trial is a staff-accompanied visit during which our team presents a selection of rugs at your premises. No rug is left with the customer. A purchase decision must be made during the visit. The service does not constitute a loan, rental, or reservation of any product.
2. Product availability. Rugs presented during a Home Trial remain listed and available for direct online purchase until a sale is completed. If an online order is placed for a rug that is scheduled for a Home Trial but has not yet physically departed for that visit, the online order takes priority and the Home Trial customer will be notified accordingly. Once a rug is physically in transit or present at the Home Trial location, it will be temporarily held for that visit.
3. Damage during a Home Trial. Although our staff take every precaution during the visit, any damage to a rug caused by the customer or persons at the premises during the visit will be treated as a completed sale, and the full purchase price of the rug will be due.
4. Service fee. The Home Trial service is currently provided free of charge. We reserve the right to introduce a service fee in the future, with advance notice posted on the website.
5. Scheduling and cancellation. We reserve the right to reschedule or cancel a Home Trial visit at our discretion. Booking a Home Trial does not constitute a reservation or purchase of any product.

 

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged is the price at checkout and in your confirmation email. Unless expressly stated, posted prices exclude taxes, shipping, and handling. VAT will be applied where applicable and reflected on your tax invoice (TRN provided below).
You agree to provide current, complete, and accurate purchase and payment information and to keep your account details up to date. You represent that (i) the payment method details you provide are true and you are authorized to use the method; (ii) charges will be honored by your provider; and (iii) you will pay all amounts due, including taxes and shipping. Cash on Delivery is not available.

SECTION 5 – SHIPPING AND DELIVERY

Delivery timeframes are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. This section does not limit your UAE consumer rights concerning damaged or defective goods.

SECTION 6 – INTELLECTUAL PROPERTY

All trademarks, trade names, logos, text, designs, graphics, photographs, video, audio, product reviews, and the design and arrangement thereof available through the Services are owned by Aiba World or our licensors and are protected by applicable laws. You may use the Services for personal, non-commercial use only. No license is granted except as expressly set out in these Terms. Aiba World names and logos are our trademarks. Shopify names and logos are trademarks of Shopify. Other names and logos are the property of their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide access to tools or features from third parties that we do not control. Such tools are provided “as is” and “as available,” without warranties or endorsement. Your use is at your own risk and subject to the third party’s terms. New features released in the future will be part of the Services and subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain third-party materials or links. We are not responsible for examining or evaluating the content or accuracy of third-party materials and are not liable for any harm or damages arising from your use of them. Review third-party policies and terms carefully before engaging in any transaction.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Aiba World is powered by Shopify, which enables the Services, but all sales are made directly by Aiba World. Shopify is not responsible for any aspect of your purchases or transactions with us. You expressly release Shopify and its affiliates from all claims arising from or related to your purchases from Aiba World.

SECTION 10 – PRIVACY POLICY

Personal information collected through the Services is handled under our Privacy Policy LINK. Because the Services are hosted by Shopify, certain data about your use of the store is processed by Shopify and may be transferred outside the UAE to provide and improve the Services. SECTION 11 – FEEDBACK

If you submit reviews, ideas, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and display that Feedback for any purpose, including to operate and improve the Services. You warrant you own or control the rights to your Feedback and that it complies with these Terms and applicable law. We may monitor, edit, or remove Feedback that we determine is unlawful, infringing, or otherwise objectionable.

SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS

Information on the Services may contain typographical errors, inaccuracies, or omissions, including in product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability. We may correct any errors and update information or cancel orders if any information is inaccurate, without prior notice, including after you submit your order.

SECTION 13 – PROHIBITED USES

You may use the Services only for lawful purposes. You agree not to, among other things: violate any applicable laws; infringe intellectual property rights; harass or harm others; transmit false, misleading, or non-compliant content; send spam; upload malware; scrape or crawl; or attempt to bypass security or access controls. We may suspend or terminate access for violations.

SECTION 14 – TERMINATION

We may terminate or suspend access to the Services at any time, with or without notice. You remain liable for amounts due up to the date of termination. Provisions that by their nature should survive termination (including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, and Privacy) will survive.

SECTION 15 – DISCLAIMER OF WARRANTIES

Except as expressly stated by Aiba World, the Services and all products offered through the Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, durability, title, and non-infringement. Nothing in this section limits non-waivable consumer rights under UAE law.

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Aiba World and our directors, officers, employees, affiliates, agents, contractors, service providers, and licensors (and Shopify and its affiliates) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, savings, data, or replacement costs, arising from your use of the Services or any products purchased through the Services, even if advised of the possibility of such damages. Nothing herein excludes or limits liability where such exclusion or limitation is not permitted by UAE law.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless Aiba World, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims and expenses (including reasonable legal fees) arising out of your breach of these Terms, violation of law, or misuse of the Services.

SECTION 18 – SEVERABILITY

If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Our failure to enforce any provision is not a waiver. These Terms and any policies or rules posted on the site constitute the entire agreement between you and us regarding the Services and supersede all prior agreements.

SECTION 20 – ASSIGNMENT

You may not assign or transfer any rights or obligations under these Terms without our written consent. We may assign or transfer these Terms without notice.

SECTION 21 – GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and any separate agreements whereby we provide Services are governed by the laws of the United Arab Emirates and the laws of the Emirate of Ajman, to the extent they apply, without regard to conflict-of-laws rules. You and Aiba World agree to the exclusive jurisdiction of the courts of Ajman, UAE. (Entity established in Ajman Free Zone; see license details.)

SECTION 23 – CHANGES TO TERMS OF SERVICE

You can review the most current version of the Terms at any time on this page. We may update or replace parts of these Terms by posting changes on the website. We will provide notice of material changes as required by law. Your continued use of the Services after changes are posted constitutes acceptance of the changes.
